日前,自然資源(yuan)部(bu)辦公廳印(yin)發(fa)(fa)《關(guan)于加強臨時用地監管有(you)關(guan)工作的(de)通(tong)知(zhi)》(以下簡(jian)稱《通(tong) 知(zhi) 》),部(bu)自然資源(yuan)開(kai)發(fa)(fa)利用司主要負責人就相關(guan)內容進行了全面解讀。
堅持問題(ti)導向(xiang)解決(jue)臨時用地監管難
據(ju)介(jie)紹,自然(ran)資源部(bu)針對一些地方暴露(lu)出的臨(lin)時用(yong)地不(bu)臨(lin)時、侵占耕地紅線等(deng)亟(ji)待規范(fan)整治的問題,于(yu)2021年制定出臺了(le)《自然資源部(bu)關(guan)于規(gui)范臨時用地(di)管(guan)理的(de)(de)通知(zhi)》(自然資規(gui)〔2021〕2號),各(ge)地(di)認(ren)真貫(guan)徹落實,加強(qiang)臨時用地(di)管(guan)理,但也反映存在(zai)一些實際問題(ti)。對此,自然資源部(bu)按照學(xue)習貫(guan)徹習近平新時代中(zhong)國特(te)色社會(hui)主(zhu)義思想主(zhu)題(ti)教育要求(qiu),以實際工作中(zhong)發(fa)現的(de)(de)問題(ti)為(wei)導向(xiang)開展(zhan)調(diao)查研(yan)究,向(xiang)各(ge)省份征(zheng)求(qiu)并匯(hui)總(zong)形(xing)成相關(guan)意(yi)見48條(tiao),在(zai)充分采納吸(xi)收(shou)各(ge)地(di)意(yi)見的(de)(de)基礎(chu)上,又征(zheng)求(qiu)收(shou)集部(bu)內司(si)局意(yi)見17條(tiao),經過廣泛討論、深入調(diao)研(yan),在(zai)原有政策(ce)基礎(chu)上起草《通知(zhi)》進一步強(qiang)化監管(guan)措施。
從各方面反映的情況來看,臨(lin)(lin)時(shi)用(yong)地(di)(di)(di)(di)監(jian)管主要存在四(si)(si)方面問題(ti):一是臨(lin)(lin)時(shi)用(yong)地(di)(di)(di)(di)審(shen)批(pi)數據(ju)(ju)與(yu)國土(tu)變更調查(cha)(cha)、衛(wei)片(pian)執法檢查(cha)(cha)數據(ju)(ju)銜(xian)接(jie)缺失;二是存量臨(lin)(lin)時(shi)用(yong)地(di)(di)(di)(di)使(shi)用(yong)監(jian)管責任不到位;三是現行(xing)《土(tu)地(di)(di)(di)(di)管理法實施(shi)條例》修訂頒布前后能源(yuan)、交通(tong)、水(shui)利等(deng)(deng)基礎設施(shi)臨(lin)(lin)時(shi)用(yong)地(di)(di)(di)(di)使(shi)用(yong)期限銜(xian)接(jie)不暢;四(si)(si)是油氣(qi)鉆(zhan)井及配套設施(shi)等(deng)(deng)能源(yuan)基礎設施(shi)臨(lin)(lin)時(shi)用(yong)地(di)(di)(di)(di)使(shi)用(yong)期限、臨(lin)(lin)時(shi)用(yong)地(di)(di)(di)(di)期滿后續利用(yong)等(deng)(deng)政策(ce)尚不明(ming)確;五是臨(lin)(lin)時(shi)用(yong)地(di)(di)(di)(di)審(shen)批(pi)信(xin)息與(yu)監(jian)管落實不夠等(deng)(deng)問題(ti)。
這(zhe)次印(yin)發《通知》,以解(jie)決上述問題(ti)為導向,并根據地(di)(di)方實(shi)際情況和現(xian)實(shi)需求進(jin)一(yi)步加強(qiang)臨時用地(di)(di)監(jian)(jian)督與管(guan)理,主要(yao)(yao)從全面實(shi)現(xian)臨時用地(di)(di)上圖入(ru)庫、加快存量(liang)臨時用地(di)(di)信息補錄、做(zuo)好(hao)臨時用地(di)(di)政(zheng)策(ce)銜(xian)接、強(qiang)化臨時用地(di)(di)監(jian)(jian)管(guan)等四個方面明確有關政(zheng)策(ce)措(cuo)施,增強(qiang)臨時用地(di)(di)監(jian)(jian)管(guan)的規范性和可(ke)操作性。這(zhe)也是自然資源部在主題(ti)教育中全面貫徹落實(shi)黨的二十大精神,嚴格保(bao)護(hu)耕地(di)(di)、促進(jin)節約(yue)集約(yue)用地(di)(di)的重要(yao)(yao)舉措(cuo)之一(yi)。
推動臨時(shi)用地全面上圖(tu)入(ru)庫(ku)
為了解決臨(lin)時用(yong)地審批數(shu)據(ju)與(yu)國土(tu)變更調查、衛片執法(fa)(fa)檢查數(shu)據(ju)銜(xian)接不夠問題,《通(tong)知》明確(que)要(yao)求(qiu)市、縣(xian)在(zai)臨(lin)時用(yong)地經依法(fa)(fa)批準(zhun)后20個工作日內,通(tong)過系統(tong)將臨時(shi)用(yong)地信息(xi)上圖(tu)入(ru)庫(ku)(ku)。臨時(shi)用(yong)地日常監管和(he)土地衛片執法、自然(ran)資源(yuan)督(du)察、國土變更調查等工作中涉及臨時(shi)用(yong)地的,以系統(tong)信息(xi)為基本依據。系統(tong)中沒(mei)有上圖(tu)入(ru)庫(ku)(ku)信息(xi)的,不(bu)(bu)予認可(ke)為臨時(shi)用(yong)地;上圖(tu)入(ru)庫(ku)(ku)信息(xi)經查核(he),不(bu)(bu)屬于臨時(shi)用(yong)地的,及時(shi)指出并整改(gai)處理。
那么,該如何(he)界定(ding)上(shang)圖入(ru)(ru)庫的(de)(de)臨(lin)(lin)時(shi)用(yong)(yong)(yong)地(di)(di)(di)(di)范(fan)(fan)圍(wei)?該負責人指出,《通知》進一步(bu)明(ming)確了(le)臨(lin)(lin)時(shi)用(yong)(yong)(yong)地(di)(di)(di)(di)審(shen)批地(di)(di)(di)(di)類和填報范(fan)(fan)圍(wei),規定(ding)上(shang)圖入(ru)(ru)庫的(de)(de)臨(lin)(lin)時(shi)用(yong)(yong)(yong)地(di)(di)(di)(di)范(fan)(fan)圍(wei)是在農用(yong)(yong)(yong)地(di)(di)(di)(di)或(huo)未利用(yong)(yong)(yong)地(di)(di)(di)(di)上(shang)的(de)(de)臨(lin)(lin)時(shi)用(yong)(yong)(yong)地(di)(di)(di)(di),經依法批準的(de)(de)國有或(huo)集體建(jian)設用(yong)(yong)(yong)地(di)(di)(di)(di)上(shang)臨(lin)(lin)時(shi)使(shi)用(yong)(yong)(yong)土地(di)(di)(di)(di)的(de)(de),不納入(ru)(ru)上(shang)圖入(ru)(ru)庫范(fan)(fan)圍(wei)。
加快存量臨時(shi)用地信息補錄
針對存量臨時用(yong)地(di)底數不(bu)(bu)清、使(shi)用(yong)和復墾過程監管不(bu)(bu)夠問題,《通知》要求以(yi)2021年(nian)國(guo)土變更調查認(ren)定的臨時用地圖(tu)斑(ban)為底數,由市(縣)自然資源主管部門(men)根據臨時用地現狀分類(lei)研究處置,該(gai)上(shang)圖(tu)入(ru)庫的及時補充(chong)上(shang)圖(tu)入(ru)庫。
該負(fu)責人表(biao)示,對2022年1月(yue)1日前(qian)發(fa)生(sheng)的(de)存量臨時(shi)用(yong)地(di)(di),區(qu)分(fen)情(qing)形后補(bu)錄信(xin)息(xi),屬(shu)于(yu)《通知》下發(fa)前(qian)臨時(shi)用(yong)地(di)(di)已(yi)使(shi)用(yong)完(wan)畢、并完(wan)成復(fu)(fu)墾且(qie)驗(yan)收(shou)合格的(de),不再(zai)補(bu)錄信(xin)息(xi);屬(shu)于(yu)目前(qian)仍在(zai)規(gui)定的(de)使(shi)用(yong)期(qi)內(nei)(nei)使(shi)用(yong)或(huo)復(fu)(fu)墾期(qi)限(xian)內(nei)(nei)未(wei)復(fu)(fu)墾的(de),市(縣(xian))自然資(zi)源主(zhu)管部(bu)(bu)門應(ying)在(zai)2023年底前(qian)將臨時(shi)用(yong)地(di)(di)信(xin)息(xi)在(zai)系統中(zhong)上圖入(ru)庫(ku),完(wan)整(zheng)填報相關批準信(xin)息(xi);屬(shu)于(yu)超出規(gui)定使(shi)用(yong)期(qi)限(xian)仍在(zai)使(shi)用(yong)或(huo)未(wei)復(fu)(fu)墾的(de),補(bu)錄信(xin)息(xi)后,市(縣(xian))自然資(zi)源主(zhu)管部(bu)(bu)門應(ying)督促限(xian)期(qi)整(zheng)改,嚴格按照臨時(shi)用(yong)地(di)(di)規(gui)定履行復(fu)(fu)墾義務;屬(shu)于(yu)實際已(yi)經修建(jian)永久性建(jian)(構(gou))筑物的(de),臨時(shi)用(yong)地(di)(di)不再(zai)補(bu)錄信(xin)息(xi),由市(縣(xian))自然資(zi)源主(zhu)管部(bu)(bu)門建(jian)立臺(tai)賬,納(na)入(ru)違法(fa)用(yong)地(di)(di)進行處理。
做(zuo)好臨時用地政策文件內容銜接(jie)
現行《土地管理(li)法實(shi)施(shi)條(tiao)例》修(xiu)訂(ding)頒布前,地方根據原法律規(gui)定已經批準的能源、交通、水(shui)利等基礎設施(shi)臨時用地,大部分即將期(qi)滿或已經期(qi)滿。這類問題(ti)該(gai)如何解(jie)決?
該負責(ze)人提(ti)出,對于使用期限已(yi)超過2年(nian)又確(que)需繼續使(shi)(shi)用(yong)(yong)的(de)(de),《通知》明確(que)在不(bu)改變用(yong)(yong)地位置、不(bu)擴大用(yong)(yong)地規(gui)模的(de)(de)條件下,經(jing)原審批機關(guan)批準可以繼續使(shi)(shi)用(yong)(yong),但總的(de)(de)使(shi)(shi)用(yong)(yong)期(qi)限(xian)不(bu)得超(chao)過四(si)年(nian)。同時,進一(yi)步明確(que)能源基礎設(she)施臨(lin)(lin)時用(yong)(yong)地期(qi)限(xian),油氣探(tan)采合一(yi)開發(fa)涉及(ji)的(de)(de)鉆井(jing)及(ji)配套設(she)施依據2號文件審批的(de)(de)臨(lin)(lin)時用(yong)(yong)地,使(shi)(shi)用(yong)(yong)期(qi)限(xian)不(bu)超(chao)過四(si)年(nian)。此外,嚴格油氣企業(ye)在勘(kan)探(tan)結(jie)束轉(zhuan)入開采建(jian)設(she)用(yong)(yong)地審批手續辦(ban)(ban)理(li)要求,明確(que)未(wei)在規(gui)定期(qi)限(xian)內辦(ban)(ban)理(li)建(jian)設(she)用(yong)(yong)地手續的(de)(de),按違法用(yong)(yong)地處(chu)理(li)。
為(wei)了減少資(zi)源浪費(fei),合(he)理(li)使用(yong)(yong)(yong)(yong)臨時用(yong)(yong)(yong)(yong)地(di)(di)(di)并嚴格保(bao)護耕地(di)(di)(di),《通知》提(ti)出對于占用(yong)(yong)(yong)(yong)耕地(di)(di)(di)以(yi)(yi)外其(qi)他地(di)(di)(di)類(lei)的(de)臨時用(yong)(yong)(yong)(yong)地(di)(di)(di),在規定(ding)使用(yong)(yong)(yong)(yong)期限內(nei),在不改變(bian)用(yong)(yong)(yong)(yong)途(tu)和范圍的(de)前提(ti)下,經臨時用(yong)(yong)(yong)(yong)地(di)(di)(di)原審(shen)批(pi)機(ji)關批(pi)準,可以(yi)(yi)確(que)(que)定(ding)給其(qi)他建設作為(wei)臨時用(yong)(yong)(yong)(yong)地(di)(di)(di)使用(yong)(yong)(yong)(yong),但必須確(que)(que)保(bao)土地(di)(di)(di)復墾(ken)義務(wu)履(lv)行到位。為(wei)了減輕企業資(zi)金(jin)壓力(li),《通知》還明確(que)(que)提(ti)出在確(que)(que)保(bao)臨時用(yong)(yong)(yong)(yong)地(di)(di)(di)土地(di)(di)(di)復墾(ken)落實(shi)的(de)前提(ti)下,地(di)(di)(di)方可以(yi)(yi)探索使用(yong)(yong)(yong)(yong)銀行保(bao)函預存土地(di)(di)(di)復墾(ken)費(fei)用(yong)(yong)(yong)(yong)。
該負責人強調(diao),要做(zuo)好與相關文件內容銜接,“本通知印發后(hou),相關文件(jian)臨時用(yong)地(di)規定與本通知不一致的,以本通知為準”。
強化臨時用地指導與(yu)監(jian)管責任(ren)
該負責人(ren)表(biao)示,臨時(shi)用地監(jian)管要強(qiang)化省級自然資源主管部(bu)門(men)責任,自然資源部(bu)將(jiang)加強(qiang)臨時(shi)用地日常監(jian)督(du)抽查,對于問題突出的省份公開通報(bao)。
省(sheng)級自然資源主管部門負責檢(jian)查把關臨(lin)(lin)(lin)時(shi)(shi)(shi)用(yong)地(di)(di)上(shang)圖入庫信(xin)息,確保信(xin)息填(tian)報及時(shi)(shi)(shi)準確,對于(yu)信(xin)息補錄、修(xiu)改(gai)量大且(qie)排在(zai)本省(sheng)份前列的市(縣),及時(shi)(shi)(shi)提出(chu)整改(gai)要(yao)求。同時(shi)(shi)(shi),定期(qi)梳(shu)理分析(xi)單個項(xiang)目(mu)臨(lin)(lin)(lin)時(shi)(shi)(shi)用(yong)地(di)(di)規模明(ming)顯偏大、未按期(qi)完(wan)成土(tu)地(di)(di)復墾等異常(chang)情(qing)(qing)形,監(jian)督(du)臨(lin)(lin)(lin)時(shi)(shi)(shi)用(yong)地(di)(di)審批信(xin)息公示情(qing)(qing)況,及時(shi)(shi)(shi)發現(xian)苗頭性問題(ti)并督(du)促整改(gai)。在(zai)監(jian)督(du)管理中,如果發現(xian)違(wei)法違(wei)規審批臨(lin)(lin)(lin)時(shi)(shi)(shi)用(yong)地(di)(di)或者批后(hou)改(gai)變臨(lin)(lin)(lin)時(shi)(shi)(shi)用(yong)地(di)(di)用(yong)途修(xiu)建(jian)永久(jiu)性建(jian)(構)筑物等問題(ti)的,要(yao)嚴肅依法依規進(jin)行查處,并在(zai)系(xi)統(tong)中核銷臨(lin)(lin)(lin)時(shi)(shi)(shi)用(yong)地(di)(di)信(xin)息。
該(gai)負責(ze)人表示,自(zi)然資源部(bu)將組織開展《通知》相關政(zheng)(zheng)策(ce)內容(rong)和臨時用(yong)地信息系(xi)統操(cao)作(zuo)培訓,切實(shi)指導地方做好政(zheng)(zheng)策(ce)實(shi)施和系(xi)統使用(yong)工(gong)作(zuo),嚴格規(gui)范臨時用(yong)地管理。
