  為(wei)貫徹(che)落(luo)實(shi)黨中央、國(guo)務院關于(yu)生(sheng)(sheng)態(tai)保護修復(fu)的決策(ce)部署,深入(ru)推進(jin)國(guo)土(tu)空(kong)間生(sheng)(sheng)態(tai)修復(fu)工作,針對一些地方生(sheng)(sheng)態(tai)修復(fu)項(xiang)目(mu)實(shi)施(shi)中存在的前期工作不(bu)扎(zha)實(shi)、監督(du)管理(li)不(bu)到(dao)位、進(jin)度滯(zhi)后、實(shi)施(shi)不(bu)規(gui)范等問(wen)題,現就加強各級財政資金支持并(bing)由自(zi)然資源部門牽(qian)頭組織實(shi)施(shi)的國(guo)土(tu)空(kong)間生(sheng)(sheng)態(tai)修復(fu)項(xiang)目(mu)規(gui)范實(shi)施(shi)和監督(du)管理(li),提出如下要求。

  一(yi)、扎實(shi)做好項目前期(qi)工作

  做好項目(mu)(mu)(mu)前(qian)(qian)期(qi)(qi)工作,提(ti)高項目(mu)(mu)(mu)成熟度,是(shi)確保項目(mu)(mu)(mu)設(she)立科學(xue)合理、項目(mu)(mu)(mu)實(shi)施順利(li)有效的(de)前(qian)(qian)提(ti)和基礎。對(dui)(dui)涉及中央和地方預算(suan)內資金支(zhi)(zhi)持的(de)生(sheng)態修復項目(mu)(mu)(mu),應按(an)照(zhao)預算(suan)內投資項目(mu)(mu)(mu)管理有關(guan)規定,做好項目(mu)(mu)(mu)建議、可行性研究(jiu)、初步設(she)計等前(qian)(qian)期(qi)(qi)工作。對(dui)(dui)中央和地方財政轉(zhuan)移支(zhi)(zhi)付資金支(zhi)(zhi)持的(de)生(sheng)態修復項目(mu)(mu)(mu),應按(an)照(zhao)本通知要求(qiu),結合本地實(shi)際做好項目(mu)(mu)(mu)前(qian)(qian)期(qi)(qi)各(ge)階段工作,并(bing)落實(shi)項目(mu)(mu)(mu)儲備庫建設(she)相關(guan)要求(qiu)。

  (一)科(ke)學提出(chu)項(xiang)目建(jian)議。各地要(yao)依據國(guo)土(tu)空間規劃(hua)及(ji)生(sheng)(sheng)態(tai)保護修(xiu)復(fu)相關規劃(hua),針(zhen)對(dui)本(ben)地區生(sheng)(sheng)態(tai)保護修(xiu)復(fu)存(cun)在的突出(chu)問(wen)題,提出(chu)生(sheng)(sheng)態(tai)修(xiu)復(fu)項(xiang)目建(jian)議,科(ke)學分析論證并(bing)明確項(xiang)目實(shi)(shi)施的必要(yao)性、主要(yao)實(shi)(shi)施內容、實(shi)(shi)施范圍及(ji)規模、投資匡算、資金(jin)籌措以及(ji)生(sheng)(sheng)態(tai)效益(yi)、社會效益(yi)、經(jing)濟效益(yi)等。其中(zhong),涉及(ji)中(zhong)央財(cai)政轉移(yi)支付(fu)資金(jin)支持的項(xiang)目,已列入《全國(guo)國(guo)土(tu)空間規劃(hua)綱(gang)要(yao)(2021-2035年(nian)(nian))》《全國(guo)重要(yao)生(sheng)態系統保護和(he)(he)修復(fu)重大工程(cheng)總體(ti)規(gui)劃(hua)(2021-2035年(nian)(nian))》和(he)(he)國(guo)家級相關專(zhuan)項(xiang)規(gui)劃(hua)、行動(dong)計劃(hua)的(de),視為(wei)已同(tong)意項(xiang)目(mu)建(jian)議(yi);涉及地方各級財政資金支持的(de)項(xiang)目(mu),已納入本(ben)級國(guo)土空間規(gui)劃(hua)“一張圖”和(he)(he)生(sheng)態修復(fu)相關規(gui)劃(hua)的(de),視為(wei)已同(tong)意項(xiang)目(mu)建(jian)議(yi)。

  (二)深化項(xiang)(xiang)目可(ke)(ke)行性研究。各地要(yao)扎實開展實地踏勘、調(diao)查(cha)評(ping)價、問題識別(bie)等,就修復(fu)模式、技術措施(shi)、實施(shi)保障等深入研究。涉及權屬和利益調(diao)整(zheng)的(de),項(xiang)(xiang)目組織實施(shi)單位(wei)要(yao)與利益相(xiang)關方(fang)協商并(bing)達成(cheng)一致(zhi)意見;涉及相(xiang)關行政(zheng)許(xu)可(ke)(ke)事(shi)項(xiang)(xiang)的(de),要(yao)分析評(ping)估項(xiang)(xiang)目獲得行政(zheng)許(xu)可(ke)(ke)的(de)可(ke)(ke)行性。在(zai)此(ci)基礎上,按照《國土空間生態保護修復(fu)工(gong)程(cheng)實施(shi)方(fang)案編制規(gui)程(cheng)》( TD /T1068-2022)等技術規范要(yao)求編制(zhi)實施(shi)方(fang)(fang)案,并(bing)至少(shao)達到(dao)可(ke)行性研究(jiu)深(shen)度,按(an)有關規定報批。各地審查(cha)批準實施(shi)方(fang)(fang)案,要(yao)將項(xiang)目(mu)(mu)成熟度作為(wei)重要(yao)審查(cha)內容,必要(yao)時可(ke)請有關方(fang)(fang)面(mian)提供(gong)支撐(cheng)材料。經(jing)批準的實施(shi)方(fang)(fang)案作為(wei)確立項(xiang)目(mu)(mu)的依據。

  (三)扎實(shi)開(kai)展(zhan)項(xiang)(xiang)目工(gong)程(cheng)(cheng)(cheng)設(she)(she)計(ji)。各(ge)地應依據(ju)實(shi)施(shi)(shi)方(fang)案(an)及相關批復文件,按照(zhao)有關技術規(gui)范,組織(zhi)開(kai)展(zhan)工(gong)程(cheng)(cheng)(cheng)設(she)(she)計(ji),明確(que)各(ge)子項(xiang)(xiang)目具體實(shi)施(shi)(shi)范圍、內容、規(gui)模、措施(shi)(shi)、標準等,編制投資概算,細(xi)化資金使用和(he)績效目標等。對(dui)于實(shi)施(shi)(shi)范圍和(he)規(gui)模較(jiao)小(xiao)、期限較(jiao)短的項(xiang)(xiang)目,實(shi)施(shi)(shi)方(fang)案(an)已達到(dao)(dao)工(gong)程(cheng)(cheng)(cheng)設(she)(she)計(ji)深度的,可不再另行開(kai)展(zhan)工(gong)程(cheng)(cheng)(cheng)設(she)(she)計(ji)。工(gong)程(cheng)(cheng)(cheng)設(she)(she)計(ji)(或達到(dao)(dao)工(gong)程(cheng)(cheng)(cheng)設(she)(she)計(ji)深度的實(shi)施(shi)(shi)方(fang)案(an))按規(gui)定程(cheng)(cheng)(cheng)序(xu)報有關部門(men)審(shen)查同(tong)意后,作(zuo)為項(xiang)(xiang)目建設(she)(she)的依據(ju)。

  (四(si))強(qiang)化項(xiang)目(mu)評(ping)估論(lun)(lun)證(zheng)(zheng)。各地(di)要加強(qiang)項(xiang)目(mu)前(qian)期(qi)工作各環節專(zhuan)家論(lun)(lun)證(zheng)(zheng)和(he)公眾參與,鼓勵引入專(zhuan)業機(ji)構(gou)開展第(di)三方技(ji)術評(ping)估論(lun)(lun)證(zheng)(zheng),對項(xiang)目(mu)技(ji)術可(ke)行性(xing)、措(cuo)施科學性(xing)、經(jing)濟合理性(xing)以(yi)及生(sheng)態效(xiao)益、社(she)會效(xiao)益、經(jing)濟效(xiao)益等(deng)做出全面分析論(lun)(lun)證(zheng)(zheng),為項(xiang)目(mu)決策提供支撐(cheng)。

  (五)規(gui)范完(wan)成(cheng)開工(gong)(gong)前(qian)其他相(xiang)(xiang)關工(gong)(gong)作。各地(di)要(yao)(yao)規(gui)范完(wan)成(cheng)開工(gong)(gong)前(qian)的各項(xiang)(xiang)(xiang)(xiang)準(zhun)(zhun)備工(gong)(gong)作,確保預算一經下達,即(ji)能實(shi)際執行,形成(cheng)實(shi)物工(gong)(gong)作量。其中,涉及(ji)用地(di)(林、草)、用海(島)以及(ji)需要(yao)(yao)開展環境影響評價等的,應(ying)在開工(gong)(gong)前(qian)按相(xiang)(xiang)關規(gui)定完(wan)成(cheng)審(shen)批(pi)手續。對在規(gui)定開工(gong)(gong)時(shi)間前(qian)不能完(wan)成(cheng)相(xiang)(xiang)關準(zhun)(zhun)備工(gong)(gong)作的,要(yao)(yao)抓緊組織(zhi)整(zheng)(zheng)改(gai)。開工(gong)(gong)前(qian)準(zhun)(zhun)備工(gong)(gong)作情(qing)況(kuang)和問(wen)題(ti)整(zheng)(zheng)改(gai)情(qing)況(kuang)要(yao)(yao)與項(xiang)(xiang)(xiang)(xiang)目資金(jin)(jin)安(an)排掛鉤(gou)。對涉及(ji)中央財政轉移支付資金(jin)(jin)支持的項(xiang)(xiang)(xiang)(xiang)目,還應(ying)符合項(xiang)(xiang)(xiang)(xiang)目申(shen)報和實(shi)施等有關要(yao)(yao)求。

  二(er)、強化(hua)項(xiang)目實施(shi)管理(li)

  (一)建立并(bing)落(luo)實(shi)(shi)(shi)(shi)(shi)(shi)實(shi)(shi)(shi)(shi)(shi)(shi)施(shi)(shi)(shi)管(guan)(guan)理(li)(li)制度。各地(di)要加強(qiang)項(xiang)(xiang)目(mu)(mu)實(shi)(shi)(shi)(shi)(shi)(shi)施(shi)(shi)(shi)過程的(de)(de)(de)監(jian)督和指導(dao),明確項(xiang)(xiang)目(mu)(mu)實(shi)(shi)(shi)(shi)(shi)(shi)施(shi)(shi)(shi)和管(guan)(guan)理(li)(li)責(ze)任主體(ti),強(qiang)化實(shi)(shi)(shi)(shi)(shi)(shi)施(shi)(shi)(shi)管(guan)(guan)理(li)(li)。要結合(he)(he)本地(di)實(shi)(shi)(shi)(shi)(shi)(shi)際,按有(you)關(guan)規(gui)定建立并(bing)落(luo)實(shi)(shi)(shi)(shi)(shi)(shi)項(xiang)(xiang)目(mu)(mu)法人制、招標(biao)投標(biao)制、監(jian)理(li)(li)制、合(he)(he)同(tong)管(guan)(guan)理(li)(li)制、驗收制等制度,確保項(xiang)(xiang)目(mu)(mu)實(shi)(shi)(shi)(shi)(shi)(shi)施(shi)(shi)(shi)規(gui)范有(you)序。要探索(suo)開展監(jian)測評價和適應性管(guan)(guan)理(li)(li),研判項(xiang)(xiang)目(mu)(mu)實(shi)(shi)(shi)(shi)(shi)(shi)施(shi)(shi)(shi)中出現的(de)(de)(de)生(sheng)態(tai)問題及潛(qian)在(zai)生(sheng)態(tai)風險,對可能(neng)導(dao)致偏離生(sheng)態(tai)修(xiu)復目(mu)(mu)標(biao)或(huo)造成(cheng)新的(de)(de)(de)生(sheng)態(tai)問題的(de)(de)(de)修(xiu)復措施(shi)(shi)(shi),及時予以糾正。其中,對中央(yang)和地(di)方預(yu)算內(nei)資金支持(chi)的(de)(de)(de)項(xiang)(xiang)目(mu)(mu),按照預(yu)算內(nei)投資項(xiang)(xiang)目(mu)(mu)管(guan)(guan)理(li)(li)有(you)關(guan)規(gui)定執(zhi)行。

  (二)規(gui)范實(shi)(shi)(shi)施(shi)(shi)方(fang)(fang)案(an)調整(zheng)。對(dui)中央(yang)財(cai)政轉移支(zhi)付(fu)資(zi)金(jin)(jin)支(zhi)持(chi)項(xiang)目,確有(you)必要(yao)調整(zheng)實(shi)(shi)(shi)施(shi)(shi)方(fang)(fang)案(an)的(de),按照資(zi)金(jin)(jin)管理辦(ban)法等相關規(gui)定分(fen)類處置;擬(ni)對(dui)實(shi)(shi)(shi)施(shi)(shi)區域(yu)(yu)、實(shi)(shi)(shi)施(shi)(shi)內(nei)容、績(ji)效(xiao)目標等作出重大調整(zheng)的(de),擬(ni)調整(zheng)區域(yu)(yu)、實(shi)(shi)(shi)施(shi)(shi)內(nei)容等涉及(ji)的(de)工(gong)(gong)程(cheng)應立即停工(gong)(gong),待實(shi)(shi)(shi)施(shi)(shi)方(fang)(fang)案(an)及(ji)工(gong)(gong)程(cheng)設計按照有(you)關規(gui)定批(pi)準或備案(an)后再行實(shi)(shi)(shi)施(shi)(shi),不得邊審批(pi)、邊施(shi)(shi)工(gong)(gong)。對(dui)地方(fang)(fang)財(cai)政轉移支(zhi)付(fu)資(zi)金(jin)(jin)支(zhi)持(chi)項(xiang)目,各地應參照上述原則要(yao)求,對(dui)實(shi)(shi)(shi)施(shi)(shi)方(fang)(fang)案(an)調整(zheng)作出具體規(gui)定。

  (三)規范(fan)開展(zhan)驗收。各級自(zi)然資源主管部門應按照“誰(shui)立項(xiang)、誰(shui)驗(yan)(yan)(yan)收(shou)(shou)”原則,依據(ju)《國(guo)土空(kong)間(jian)生態(tai)保護(hu)修(xiu)復(fu)工程驗(yan)(yan)(yan)收(shou)(shou)規(gui)(gui)范》( TD / T 1069-2022)等標(biao)準,針對(dui)各類國(guo)土空(kong)間(jian)生態(tai)修(xiu)復(fu)項(xiang)目(mu)特點,分級(ji)(ji)分類規(gui)(gui)范開(kai)展(zhan)項(xiang)目(mu)驗(yan)(yan)(yan)收(shou)(shou)。對(dui)于(yu)設置子項(xiang)目(mu)的(de)(de),應在子項(xiang)目(mu)完成驗(yan)(yan)(yan)收(shou)(shou)基礎上(shang),開(kai)展(zhan)整(zheng)體(ti)驗(yan)(yan)(yan)收(shou)(shou);劃(hua)分生態(tai)保護(hu)修(xiu)復(fu)單元(yuan)的(de)(de),在整(zheng)體(ti)驗(yan)(yan)(yan)收(shou)(shou)中應開(kai)展(zhan)單元(yuan)評估。中央(yang)財政轉移支付資(zi)金支持的(de)(de)項(xiang)目(mu),由省(sheng)級(ji)(ji)相關部門負(fu)責組(zu)織整(zheng)體(ti)驗(yan)(yan)(yan)收(shou)(shou)。項(xiang)目(mu)驗(yan)(yan)(yan)收(shou)(shou)涉(she)及地(di)類變(bian)(bian)(bian)更的(de)(de),按(an)規(gui)(gui)定先納入(ru)年度(du)國(guo)土變(bian)(bian)(bian)更調查(cha)(按(an)照國(guo)土變(bian)(bian)(bian)更調查(cha)有(you)關規(gui)(gui)定,通過(guo)日常變(bian)(bian)(bian)更機制隨時上(shang)報申請地(di)類核查(cha)),驗(yan)(yan)(yan)收(shou)(shou)意見(jian)涉(she)及地(di)類變(bian)(bian)(bian)化數據(ju)以變(bian)(bian)(bian)更調查(cha)結果為準;涉(she)及不(bu)動產產權(quan)變(bian)(bian)(bian)化的(de)(de),依法(fa)依規(gui)(gui)辦理不(bu)動產登記。

  (四)做(zuo)好后期管(guan)(guan)(guan)護(hu)(hu)。項(xiang)目驗(yan)收(shou)前(qian),可提前(qian)確定后期管(guan)(guan)(guan)護(hu)(hu)責(ze)任單位(wei)并(bing)參與(yu)項(xiang)目竣(jun)工(gong)驗(yan)收(shou)。項(xiang)目驗(yan)收(shou)通過后,項(xiang)目組織(zhi)實施(shi)單位(wei)要(yao)按照工(gong)程管(guan)(guan)(guan)理職(zhi)責(ze)和受(shou)益(yi)情況等,與(yu)管(guan)(guan)(guan)護(hu)(hu)責(ze)任單位(wei)簽訂管(guan)(guan)(guan)護(hu)(hu)協議,明確管(guan)(guan)(guan)護(hu)(hu)內容(rong)、管(guan)(guan)(guan)護(hu)(hu)措施(shi)、管(guan)(guan)(guan)護(hu)(hu)周期和資金來源等。各地可根據項(xiang)目特點和實際需要(yao),開展實施(shi)效果監(jian)測評估。鼓勵引(yin)入(ru)專業機構(gou)作為第三方開展項(xiang)目實施(shi)效果評估。

  三、嚴格(ge)遵守法律(lv)法規

  (一)嚴(yan)守永久(jiu)(jiu)基本農田保(bao)護(hu)(hu)紅(hong)(hong)線(xian)和生態(tai)保(bao)護(hu)(hu)紅(hong)(hong)線(xian)。要嚴(yan)格(ge)遵守耕(geng)地和永久(jiu)(jiu)基本農田保(bao)護(hu)(hu)、生態(tai)保(bao)護(hu)(hu)相關法律法規(gui)規(gui)定(ding),嚴(yan)格(ge)落實《自(zi)然資(zi)源部 農(nong)業農(nong)村(cun)部 國家(jia)林業(ye)和草原(yuan)局關于嚴格耕地用(yong)途管制有關問(wen)題的通知》(自然(ran)資發(fa)〔2021〕166號(hao))、《自(zi)然資(zi)(zi)源部 生態環境(jing)部 國家林業和草原局關于加(jia)強生態保護紅線(xian)(xian)管理的通知(試(shi)行)》(自(zi)然資(zi)(zi)發(fa)〔2022〕142號(hao))等要求。實(shi)施生態修復項目過程中,不得擅自(zi)調整耕(geng)地(di)(di)和永(yong)久(jiu)基本農田布局,不得損毀耕(geng)地(di)(di),不得違反(fan)生態保護紅線(xian)(xian)管控規則。

  (二)嚴明(ming)資(zi)源利(li)用政(zheng)策(ce)邊界。準確把握《自(zi)然資(zi)源部關(guan)于探(tan)索利(li)用市場化方(fang)式推進礦山生(sheng)態修復的意見》(自(zi)然資(zi)規〔2019〕6號)有關要(yao)求,屬(shu)于(yu)縣(xian)級(ji)(含(han))以上地(di)方人民(min)(min)政(zheng)府(fu)組織(zhi)實(shi)施(shi)(shi)、責任人滅失的歷(li)史(shi)遺留露天開采(cai)類礦(kuang)山生(sheng)態(tai)修(xiu)(xiu)復(fu)項(xiang)目,方可適用(yong)有關合理利用(yong)廢(fei)棄(qi)礦(kuang)山土石(shi)料政(zheng)策(ce),并按照“一礦(kuang)一策(ce)”要(yao)求,在科(ke)學評估論證基礎上同(tong)(tong)(tong)步編制(zhi)土石(shi)料利用(yong)方案(an)(an)和礦(kuang)山生(sheng)態(tai)修(xiu)(xiu)復(fu)方案(an)(an),方案(an)(an)確定的實(shi)施(shi)(shi)期限原則上不超過3年,方案(an)(an)經縣(xian)級(ji)人民(min)(min)政(zheng)府(fu)同(tong)(tong)(tong)意,由(you)縣(xian)級(ji)自(zi)(zi)然資(zi)(zi)源主(zhu)管部(bu)門報市級(ji)自(zi)(zi)然資(zi)(zi)源主(zhu)管部(bu)門審查同(tong)(tong)(tong)意后實(shi)施(shi)(shi);凡(fan)涉及(ji)剩余廢(fei)棄(qi)土石(shi)料對外銷售(shou)(shou)的,由(you)縣(xian)級(ji)人民(min)(min)政(zheng)府(fu)組織(zhi)納入公共資(zi)(zi)源交(jiao)易平(ping)臺進(jin)行銷售(shou)(shou),不得由(you)項(xiang)目承擔單位(wei)、施(shi)(shi)工單位(wei)或個人直接銷售(shou)(shou),銷售(shou)(shou)所得收(shou)(shou)益納入本(ben)級(ji)人民(min)(min)政(zheng)府(fu)財政(zheng)賬戶,全部(bu)用(yong)于(yu)本(ben)地(di)區生(sheng)態(tai)修(xiu)(xiu)復(fu),涉及(ji)社會投資(zi)(zi)主(zhu)體承擔修(xiu)(xiu)復(fu)工程的應(ying)保(bao)障其合理收(shou)(shou)益。

  (三)嚴(yan)格(ge)用海(hai)用島規(gui)(gui)定(ding)。嚴(yan)禁(jin)借海(hai)洋生(sheng)態保(bao)護修(xiu)復之名,變(bian)相實(shi)施(shi)(shi)、造成(cheng)事實(shi)性填(圍)海(hai)或人工(gong)促淤。在海(hai)島修(xiu)復項目中,嚴(yan)禁(jin)實(shi)施(shi)(shi)各類違反法律(lv)法規(gui)(gui)規(gui)(gui)定(ding)的(de)采石(shi)、挖海(hai)砂、采伐林木(mu)等破壞(huai)無居民(min)海(hai)島的(de)行為,嚴(yan)格(ge)限制填海(hai)連島、嚴(yan)重改(gai)(gai)變(bian)海(hai)島自然地(di)(di)形地(di)(di)貌(mao)等對生(sheng)態環境有較大影(ying)響(xiang)的(de)用島活動。涉及灘涂高程或濕(shi)地(di)(di)微地(di)(di)貌(mao)改(gai)(gai)造的(de)(含沙灘補沙、植被(bei)種植等),不(bu)得將潮(chao)間帶、潮(chao)下帶改(gai)(gai)造為潮(chao)上帶。實(shi)施(shi)(shi)生(sheng)態保(bao)護修(xiu)復項目,不(bu)得違背自然規(gui)(gui)律(lv),采用人工(gong)干(gan)預方式建設人造沙灘;不(bu)得改(gai)(gai)變(bian)自然岸線(xian)的(de)海(hai)岸形態和(he)生(sheng)態功能;人工(gong)岸線(xian)生(sheng)態化建設應盡量達(da)到生(sheng)態恢復岸線(xian)的(de)認定(ding)標準。  

  海(hai)(hai)(hai)洋生態保護修復項目中的(de)海(hai)(hai)(hai)堤(di)(含(han)鎮壓(ya)層)、突(tu)堤(di)、離(li)岸堤(di)(含(han)潛堤(di))、棧橋、圍堰(yan)(yan)(yan)(含(han)臨(lin)(lin)時(shi)(shi)圍堰(yan)(yan)(yan))等(deng)構筑物(wu)建(jian)(jian)設,人(ren)工魚礁(jiao)(jiao)(jiao)、牡(mu)蠣附著礁(jiao)(jiao)(jiao)等(deng)礁(jiao)(jiao)(jiao)體投(tou)放、清淤(yu)疏浚及其(qi)他涉及持續(xu)使(shi)(shi)(shi)用(yong)特定海(hai)(hai)(hai)域(yu)(yu)的(de)排他性(xing)工程措(cuo)施用(yong)海(hai)(hai)(hai),在實施前應(ying)當依(yi)法依(yi)規(gui)辦理(li)海(hai)(hai)(hai)域(yu)(yu)使(shi)(shi)(shi)用(yong)審(shen)批手(shou)續(xu)或(huo)臨(lin)(lin)時(shi)(shi)海(hai)(hai)(hai)域(yu)(yu)使(shi)(shi)(shi)用(yong)手(shou)續(xu);海(hai)(hai)(hai)洋生態保護修復項目中不(bu)足三個(ge)月的(de)臨(lin)(lin)時(shi)(shi)圍堰(yan)(yan)(yan)可辦理(li)臨(lin)(lin)時(shi)(shi)海(hai)(hai)(hai)域(yu)(yu)使(shi)(shi)(shi)用(yong)手(shou)續(xu);涉及在無居民海(hai)(hai)(hai)島上開展建(jian)(jian)筑物(wu)或(huo)設施建(jian)(jian)設等(deng)開發(fa)利用(yong)活(huo)動的(de),應(ying)當依(yi)法依(yi)規(gui)辦理(li)無居民海(hai)(hai)(hai)島開發(fa)利用(yong)審(shen)批手(shou)續(xu)。需(xu)要種植植被、互(hu)花米草清理(li)、進行沙(sha)灘人(ren)工補沙(sha)等(deng)無構筑物(wu)、建(jian)(jian)筑物(wu)或(huo)設施建(jian)(jian)設的(de)非排他性(xing)用(yong)海(hai)(hai)(hai)活(huo)動,以及拆除養(yang)殖池、構筑物(wu)等(deng)不(bu)足三個(ge)月的(de)臨(lin)(lin)時(shi)(shi)施工行為工程措(cuo)施,依(yi)法依(yi)規(gui)無需(xu)辦理(li)海(hai)(hai)(hai)域(yu)(yu)使(shi)(shi)(shi)用(yong)審(shen)批手(shou)續(xu)、臨(lin)(lin)時(shi)(shi)海(hai)(hai)(hai)域(yu)(yu)使(shi)(shi)(shi)用(yong)手(shou)續(xu)或(huo)無居民海(hai)(hai)(hai)島開發(fa)利用(yong)審(shen)批手(shou)續(xu)。

  (四)嚴(yan)格資(zi)(zi)(zi)(zi)金(jin)使用(yong)管(guan)(guan)理(li)。對(dui)中(zhong)(zhong)(zhong)央(yang)(yang)和地(di)(di)方財(cai)政轉(zhuan)移支(zhi)付資(zi)(zi)(zi)(zi)金(jin)支(zhi)持的(de)項(xiang)目(mu)(mu),各地(di)(di)自(zi)然資(zi)(zi)(zi)(zi)源(yuan)部(bu)門要按照中(zhong)(zhong)(zhong)央(yang)(yang)與地(di)(di)方財(cai)政事權和支(zhi)出責(ze)任劃分,配(pei)(pei)合財(cai)政部(bu)門做(zuo)好項(xiang)目(mu)(mu)資(zi)(zi)(zi)(zi)金(jin)下達、執(zhi)行工作。中(zhong)(zhong)(zhong)央(yang)(yang)財(cai)政資(zi)(zi)(zi)(zi)金(jin)支(zhi)持范圍要符合資(zi)(zi)(zi)(zi)金(jin)管(guan)(guan)理(li)辦(ban)法等(deng)(deng)相關(guan)規(gui)定(ding);各級自(zi)然資(zi)(zi)(zi)(zi)源(yuan)主管(guan)(guan)部(bu)門應按照《自(zi)然資(zi)(zi)(zi)(zi)源(yuan)資(zi)(zi)(zi)(zi)金(jin)監(jian)測監(jian)管(guan)(guan)工作規(gui)程(cheng)》等(deng)(deng)有(you)(you)關(guan)要求,配(pei)(pei)合財(cai)政部(bu)門做(zuo)好中(zhong)(zhong)(zhong)央(yang)(yang)轉(zhuan)移支(zhi)付資(zi)(zi)(zi)(zi)金(jin)支(zhi)持項(xiang)目(mu)(mu)資(zi)(zi)(zi)(zi)金(jin)的(de)全(quan)流程(cheng)監(jian)測監(jian)管(guan)(guan),跟蹤掌(zhang)握項(xiang)目(mu)(mu)資(zi)(zi)(zi)(zi)金(jin)及績效目(mu)(mu)標(biao)執(zhi)行情況(kuang),督促按要求抓好項(xiang)目(mu)(mu)建設進度,加強對(dui)信息(xi)化監(jian)測監(jian)管(guan)(guan)成果的(de)應用(yong);省級自(zi)然資(zi)(zi)(zi)(zi)源(yuan)主管(guan)(guan)部(bu)門應配(pei)(pei)合有(you)(you)關(guan)部(bu)門制(zhi)定(ding)省級生態修(xiu)復(fu)(fu)項(xiang)目(mu)(mu)資(zi)(zi)(zi)(zi)金(jin)管(guan)(guan)理(li)辦(ban)法,有(you)(you)條件的(de)可結合當地(di)(di)實(shi)際(ji)探索編(bian)制(zhi)生態修(xiu)復(fu)(fu)項(xiang)目(mu)(mu)預算標(biao)準(zhun),提高項(xiang)目(mu)(mu)資(zi)(zi)(zi)(zi)金(jin)使用(yong)效益。對(dui)騙取、擠占、截留(liu)、挪(nuo)用(yong)項(xiang)目(mu)(mu)資(zi)(zi)(zi)(zi)金(jin)等(deng)(deng)行為,依法依規(gui)追(zhui)究責(ze)任。

  四、加(jia)強項目實(shi)施保障

  (一)完善(shan)管(guan)理(li)機(ji)制。各省(區、市(shi))要根據實際,制定本地區國土空間生態修(xiu)復(fu)項目(mu)(mu)(mu)管(guan)理(li)辦(ban)法(fa),完善(shan)項目(mu)(mu)(mu)管(guan)理(li)制度,明確各環節管(guan)理(li)要求(qiu)。中央財(cai)政(zheng)轉移(yi)支付資金支持的生態修(xiu)復(fu)項目(mu)(mu)(mu)實行省負總(zong)責(ze)、市(shi)縣實施(shi)的責(ze)任機(ji)制,承擔項目(mu)(mu)(mu)的地方應建立政(zheng)府(fu)領導、部門合作、社(she)會參與的工作機(ji)制,明確牽頭單位(wei),做(zuo)好任務分工,統籌推進項目(mu)(mu)(mu)實施(shi)。

  (二(er))強化日常監(jian)(jian)管。各地要(yao)充(chong)分利用遙(yao)感(gan)、測繪(hui)、地質調查等技術手段,對生態修復項(xiang)目實施進度(du)、效果等進行監(jian)(jian)督管理。依托(tuo)國(guo)土空間基礎(chu)信(xin)息平臺和國(guo)土空間規劃“一張圖”實施(shi)監督(du)系統(tong),融合資金監管(guan)系統(tong),因地(di)制宜探索完(wan)善國(guo)土空(kong)間生(sheng)態(tai)(tai)修(xiu)復項目(mu)監管(guan)體系。要(yao)堅持先規(gui)劃、后(hou)實施(shi),嚴格(ge)防范以(yi)生(sheng)態(tai)(tai)修(xiu)復名(ming)義違法采礦、破壞耕(geng)地(di)。要(yao)高度重視生(sheng)態(tai)(tai)修(xiu)復項目(mu)施(shi)工(gong)安全,不得“邊(bian)報批、邊(bian)設計、邊(bian)施(shi)工(gong)”,不得不顧(gu)安全盲(mang)目(mu)趕(gan)工(gong)期(qi)、搶進度。

  (三)建立問責(ze)機(ji)制。各地(di)要(yao)加大監(jian)督問責(ze)力(li)度,依法(fa)(fa)嚴(yan)肅查(cha)處(chu),責(ze)令限期整改(gai),探索建立失信懲戒(jie)機(ji)制,壓實項目(mu)勘察、設計、施工(gong)、監(jian)理等單(dan)位和人(ren)員(yuan)責(ze)任。對(dui)生態修(xiu)(xiu)復(fu)中的(de)(de)形(xing)式主義(yi)、形(xing)象工(gong)程、虛假修(xiu)(xiu)復(fu)等行為,要(yao)及(ji)時通報和曝(pu)光(guang);對(dui)造成嚴(yan)重損失、出(chu)現嚴(yan)重社會負面影響的(de)(de),要(yao)依法(fa)(fa)追究相關單(dan)位和人(ren)員(yuan)責(ze)任。對(dui)以(yi)生態修(xiu)(xiu)復(fu)名義(yi)違(wei)(wei)法(fa)(fa)采礦、破(po)壞耕地(di)、違(wei)(wei)規(gui)銷售采出(chu)礦產資(zi)源(yuan)或者超出(chu)批準的(de)(de)項目(mu)范圍采挖礦產資(zi)源(yuan)等違(wei)(wei)法(fa)(fa)行為的(de)(de),要(yao)移(yi)交執法(fa)(fa)機(ji)構調查(cha)處(chu)理。部將視情(qing)綜合(he)運用執法(fa)(fa)、檢查(cha)、約談、通報等方式開展監(jian)督。

  (四)加強社(she)會監(jian)(jian)督(du)。各地要建(jian)立健(jian)全(quan)項目公(gong)示(shi)制度,利用(yong)當地廣(guang)播、電(dian)視、報紙、政府網站等(deng),按規定公(gong)開(kai)生態修復項目基本信息及設計、施工、監(jian)(jian)理等(deng)單位信息,接受社(she)會監(jian)(jian)督(du)。加強生態保護(hu)修復科普宣傳(chuan)教(jiao)育,營造(zao)良(liang)好社(she)會氛圍。
