  為(wei)貫(guan)徹落實黨中(zhong)央、國(guo)務(wu)院關于生態保(bao)護修(xiu)復的(de)決策部(bu)(bu)署,深入推進(jin)國(guo)土空(kong)間生態修(xiu)復工(gong)作,針對一(yi)些地方生態修(xiu)復項(xiang)目(mu)實施(shi)中(zhong)存(cun)在(zai)的(de)前期(qi)工(gong)作不(bu)扎實、監督管理不(bu)到位、進(jin)度滯(zhi)后、實施(shi)不(bu)規(gui)范等問(wen)題,現就加強各級財政資(zi)金支持并由自然資(zi)源部(bu)(bu)門牽頭組織(zhi)實施(shi)的(de)國(guo)土空(kong)間生態修(xiu)復項(xiang)目(mu)規(gui)范實施(shi)和監督管理,提出如(ru)下要求。

  一(yi)、扎實(shi)做好項目前期(qi)工作

  做(zuo)(zuo)好(hao)(hao)項(xiang)(xiang)(xiang)目前(qian)期(qi)工(gong)作,提高項(xiang)(xiang)(xiang)目成熟(shu)度,是確保項(xiang)(xiang)(xiang)目設立科學(xue)合(he)理(li)、項(xiang)(xiang)(xiang)目實(shi)施順利有效的前(qian)提和(he)基礎(chu)。對(dui)涉(she)及中(zhong)央(yang)和(he)地(di)方預(yu)算(suan)內資金支持(chi)的生態修復項(xiang)(xiang)(xiang)目,應(ying)按照(zhao)預(yu)算(suan)內投(tou)資項(xiang)(xiang)(xiang)目管理(li)有關(guan)規定(ding),做(zuo)(zuo)好(hao)(hao)項(xiang)(xiang)(xiang)目建議(yi)、可行性研(yan)究、初步設計(ji)等前(qian)期(qi)工(gong)作。對(dui)中(zhong)央(yang)和(he)地(di)方財政轉移支付資金支持(chi)的生態修復項(xiang)(xiang)(xiang)目,應(ying)按照(zhao)本(ben)通(tong)知要求,結合(he)本(ben)地(di)實(shi)際做(zuo)(zuo)好(hao)(hao)項(xiang)(xiang)(xiang)目前(qian)期(qi)各階(jie)段工(gong)作,并落(luo)實(shi)項(xiang)(xiang)(xiang)目儲備庫建設相關(guan)要求。

  (一)科(ke)學(xue)提出(chu)(chu)項目(mu)建議。各地(di)要依據國(guo)土(tu)空間規(gui)劃(hua)(hua)及生態保(bao)護(hu)修復(fu)相(xiang)關規(gui)劃(hua)(hua),針(zhen)對本(ben)地(di)區生態保(bao)護(hu)修復(fu)存在(zai)的(de)突出(chu)(chu)問(wen)題,提出(chu)(chu)生態修復(fu)項目(mu)建議,科(ke)學(xue)分析論(lun)證并明確項目(mu)實(shi)施(shi)(shi)的(de)必要性、主要實(shi)施(shi)(shi)內容、實(shi)施(shi)(shi)范圍及規(gui)模、投資匡算、資金籌措以及生態效(xiao)(xiao)益(yi)(yi)、社(she)會效(xiao)(xiao)益(yi)(yi)、經濟效(xiao)(xiao)益(yi)(yi)等(deng)。其中(zhong),涉及中(zhong)央財政轉(zhuan)移支(zhi)付資金支(zhi)持(chi)的(de)項目(mu),已列入(ru)《全國(guo)國(guo)土(tu)空間規(gui)劃(hua)(hua)綱要(2021-2035年)》《全國(guo)重要生態系統保護(hu)和(he)修復重大工程總體規劃(hua)(2021-2035年)》和(he)國(guo)家級(ji)(ji)相(xiang)關(guan)專項(xiang)(xiang)規劃(hua)、行(xing)動計(ji)劃(hua)的,視為已同意(yi)項(xiang)(xiang)目(mu)建(jian)議;涉及地(di)方各級(ji)(ji)財(cai)政(zheng)資金(jin)支持的項(xiang)(xiang)目(mu),已納入本(ben)級(ji)(ji)國(guo)土空間(jian)規劃(hua)“一(yi)張圖”和(he)生態修復相(xiang)關(guan)規劃(hua)的,視為已同意(yi)項(xiang)(xiang)目(mu)建(jian)議。

  (二)深(shen)化項目(mu)可(ke)行(xing)(xing)性(xing)研究(jiu)。各地(di)要扎實開展實地(di)踏勘、調(diao)查(cha)評價、問題識別等,就修復(fu)模式、技術措施(shi)(shi)、實施(shi)(shi)保(bao)障等深(shen)入研究(jiu)。涉(she)及權屬和利益調(diao)整的,項目(mu)組織(zhi)實施(shi)(shi)單(dan)位要與利益相(xiang)關(guan)方(fang)協(xie)商并達成一致意(yi)見;涉(she)及相(xiang)關(guan)行(xing)(xing)政許(xu)可(ke)事項的,要分析評估(gu)項目(mu)獲得行(xing)(xing)政許(xu)可(ke)的可(ke)行(xing)(xing)性(xing)。在此基(ji)礎上,按照《國土空(kong)間生(sheng)態保(bao)護修復(fu)工程實施(shi)(shi)方(fang)案編(bian)制規程》( TD /T1068-2022)等技術規范要(yao)(yao)求編(bian)制實(shi)施方(fang)案(an),并至少達(da)到可(ke)行性研究(jiu)深度,按有(you)關規定報批。各地審查批準(zhun)實(shi)施方(fang)案(an),要(yao)(yao)將(jiang)項(xiang)目成(cheng)熟度作(zuo)為(wei)重(zhong)要(yao)(yao)審查內容,必要(yao)(yao)時可(ke)請有(you)關方(fang)面提供(gong)支撐材料。經批準(zhun)的(de)實(shi)施方(fang)案(an)作(zuo)為(wei)確立項(xiang)目的(de)依據。

  (三)扎實(shi)(shi)開展(zhan)項(xiang)目工(gong)程設計。各地應依據實(shi)(shi)施方案(an)(an)及相關(guan)批復文件(jian),按(an)照有(you)關(guan)技術(shu)規范(fan),組織開展(zhan)工(gong)程設計,明確各子項(xiang)目具體實(shi)(shi)施范(fan)圍(wei)、內容(rong)、規模、措(cuo)施、標(biao)準等,編制投(tou)資概算,細化(hua)資金使用和績效(xiao)目標(biao)等。對于實(shi)(shi)施范(fan)圍(wei)和規模較小、期限較短的(de)項(xiang)目,實(shi)(shi)施方案(an)(an)已達(da)到工(gong)程設計深度的(de),可不(bu)再另(ling)行開展(zhan)工(gong)程設計。工(gong)程設計(或(huo)達(da)到工(gong)程設計深度的(de)實(shi)(shi)施方案(an)(an))按(an)規定程序報有(you)關(guan)部門審查同(tong)意后,作為(wei)項(xiang)目建設的(de)依據。

  (四(si))強化項(xiang)目評估論證(zheng)(zheng)(zheng)。各地要(yao)加強項(xiang)目前期工作各環節(jie)專家論證(zheng)(zheng)(zheng)和公眾(zhong)參與,鼓勵引入(ru)專業機構開展(zhan)第三方技術評估論證(zheng)(zheng)(zheng),對(dui)項(xiang)目技術可行性(xing)、措施科學性(xing)、經濟合理性(xing)以及生態效(xiao)(xiao)益、社會效(xiao)(xiao)益、經濟效(xiao)(xiao)益等做出全面分(fen)析論證(zheng)(zheng)(zheng),為(wei)項(xiang)目決(jue)策提供(gong)支撐。

  (五)規范完(wan)成(cheng)開工(gong)(gong)(gong)(gong)(gong)(gong)前(qian)其(qi)他相關(guan)工(gong)(gong)(gong)(gong)(gong)(gong)作。各地要(yao)規范完(wan)成(cheng)開工(gong)(gong)(gong)(gong)(gong)(gong)前(qian)的(de)各項準備(bei)工(gong)(gong)(gong)(gong)(gong)(gong)作,確保(bao)預(yu)算一經下達(da),即能實際執行(xing),形(xing)成(cheng)實物工(gong)(gong)(gong)(gong)(gong)(gong)作量。其(qi)中,涉(she)及(ji)用地(林、草)、用海(島)以及(ji)需(xu)要(yao)開展環境影響評(ping)價等的(de),應在(zai)開工(gong)(gong)(gong)(gong)(gong)(gong)前(qian)按相關(guan)規定(ding)完(wan)成(cheng)審批手續。對在(zai)規定(ding)開工(gong)(gong)(gong)(gong)(gong)(gong)時間(jian)前(qian)不能完(wan)成(cheng)相關(guan)準備(bei)工(gong)(gong)(gong)(gong)(gong)(gong)作的(de),要(yao)抓(zhua)緊(jin)組織整改。開工(gong)(gong)(gong)(gong)(gong)(gong)前(qian)準備(bei)工(gong)(gong)(gong)(gong)(gong)(gong)作情(qing)況和問題整改情(qing)況要(yao)與(yu)項目資(zi)金安排掛(gua)鉤。對涉(she)及(ji)中央(yang)財政轉移支付資(zi)金支持的(de)項目,還應符合項目申報(bao)和實施等有關(guan)要(yao)求(qiu)。

  二、強(qiang)化項目實施管理

  (一)建(jian)立(li)并落實實施管(guan)(guan)理(li)制(zhi)(zhi)(zhi)(zhi)度(du)。各地要加強項(xiang)目(mu)實施過程(cheng)的(de)(de)監督(du)和(he)(he)指導,明確(que)項(xiang)目(mu)實施和(he)(he)管(guan)(guan)理(li)責任主體,強化(hua)實施管(guan)(guan)理(li)。要結合本地實際,按有(you)關規(gui)(gui)定(ding)建(jian)立(li)并落實項(xiang)目(mu)法人制(zhi)(zhi)(zhi)(zhi)、招標(biao)投標(biao)制(zhi)(zhi)(zhi)(zhi)、監理(li)制(zhi)(zhi)(zhi)(zhi)、合同管(guan)(guan)理(li)制(zhi)(zhi)(zhi)(zhi)、驗收(shou)制(zhi)(zhi)(zhi)(zhi)等制(zhi)(zhi)(zhi)(zhi)度(du),確(que)保(bao)項(xiang)目(mu)實施規(gui)(gui)范有(you)序(xu)。要探索(suo)開展(zhan)監測評價和(he)(he)適應性管(guan)(guan)理(li),研判(pan)項(xiang)目(mu)實施中(zhong)(zhong)出現的(de)(de)生態(tai)問(wen)題及潛(qian)在生態(tai)風險(xian),對可(ke)能導致偏離生態(tai)修復(fu)目(mu)標(biao)或造成新的(de)(de)生態(tai)問(wen)題的(de)(de)修復(fu)措(cuo)施,及時(shi)予以糾正。其中(zhong)(zhong),對中(zhong)(zhong)央和(he)(he)地方(fang)預(yu)算內(nei)資金支持的(de)(de)項(xiang)目(mu),按照(zhao)預(yu)算內(nei)投資項(xiang)目(mu)管(guan)(guan)理(li)有(you)關規(gui)(gui)定(ding)執行。

  (二)規范實(shi)施(shi)(shi)方(fang)(fang)案(an)(an)調整。對(dui)中央(yang)財(cai)政(zheng)轉移支付(fu)資金支持(chi)(chi)項(xiang)目(mu),確有必要調整實(shi)施(shi)(shi)方(fang)(fang)案(an)(an)的,按(an)照資金管(guan)理辦(ban)法等(deng)相關規定分類處(chu)置;擬(ni)對(dui)實(shi)施(shi)(shi)區(qu)域、實(shi)施(shi)(shi)內(nei)容、績效目(mu)標等(deng)作出重大(da)調整的,擬(ni)調整區(qu)域、實(shi)施(shi)(shi)內(nei)容等(deng)涉及的工(gong)程(cheng)應(ying)立即停工(gong),待實(shi)施(shi)(shi)方(fang)(fang)案(an)(an)及工(gong)程(cheng)設(she)計按(an)照有關規定批(pi)(pi)準或(huo)備案(an)(an)后再行實(shi)施(shi)(shi),不得邊審批(pi)(pi)、邊施(shi)(shi)工(gong)。對(dui)地(di)方(fang)(fang)財(cai)政(zheng)轉移支付(fu)資金支持(chi)(chi)項(xiang)目(mu),各地(di)應(ying)參照上述(shu)原則要求(qiu),對(dui)實(shi)施(shi)(shi)方(fang)(fang)案(an)(an)調整作出具體規定。

  (三)規范(fan)開展驗收。各級自(zi)然資源主管(guan)部門應(ying)按照“誰(shui)立項(xiang)、誰(shui)驗(yan)(yan)(yan)收(shou)(shou)”原則,依據(ju)《國土空間生態(tai)保護修復工程(cheng)驗(yan)(yan)(yan)收(shou)(shou)規(gui)范》( TD / T 1069-2022)等標準,針對各類(lei)國土空間生態(tai)修復項(xiang)目特點,分級(ji)分類(lei)規(gui)范開(kai)展項(xiang)目驗(yan)(yan)(yan)收(shou)(shou)。對于(yu)設置子項(xiang)目的(de),應(ying)在(zai)子項(xiang)目完成(cheng)驗(yan)(yan)(yan)收(shou)(shou)基礎上,開(kai)展整體驗(yan)(yan)(yan)收(shou)(shou);劃分生態(tai)保護修復單元的(de),在(zai)整體驗(yan)(yan)(yan)收(shou)(shou)中應(ying)開(kai)展單元評估(gu)。中央(yang)財政轉(zhuan)移支(zhi)付資金(jin)支(zhi)持的(de)項(xiang)目,由省(sheng)級(ji)相關部門負責(ze)組織整體驗(yan)(yan)(yan)收(shou)(shou)。項(xiang)目驗(yan)(yan)(yan)收(shou)(shou)涉(she)及地類(lei)變(bian)(bian)更(geng)的(de),按規(gui)定先(xian)納(na)入年度國土變(bian)(bian)更(geng)調(diao)查(按照國土變(bian)(bian)更(geng)調(diao)查有關規(gui)定,通過日常變(bian)(bian)更(geng)機制隨時上報申請地類(lei)核(he)查),驗(yan)(yan)(yan)收(shou)(shou)意見(jian)涉(she)及地類(lei)變(bian)(bian)化(hua)數據(ju)以變(bian)(bian)更(geng)調(diao)查結(jie)果為準;涉(she)及不(bu)動(dong)產(chan)產(chan)權變(bian)(bian)化(hua)的(de),依法依規(gui)辦理不(bu)動(dong)產(chan)登(deng)記。

  (四)做好后期管(guan)(guan)護(hu)。項(xiang)目(mu)(mu)(mu)驗收前(qian),可提(ti)前(qian)確(que)定后期管(guan)(guan)護(hu)責(ze)任單(dan)位并(bing)參與項(xiang)目(mu)(mu)(mu)竣工(gong)驗收。項(xiang)目(mu)(mu)(mu)驗收通過后,項(xiang)目(mu)(mu)(mu)組織實(shi)施(shi)(shi)單(dan)位要(yao)按(an)照工(gong)程管(guan)(guan)理職責(ze)和受益(yi)情況等(deng),與管(guan)(guan)護(hu)責(ze)任單(dan)位簽訂管(guan)(guan)護(hu)協議,明確(que)管(guan)(guan)護(hu)內容(rong)、管(guan)(guan)護(hu)措施(shi)(shi)、管(guan)(guan)護(hu)周期和資金來(lai)源等(deng)。各地可根據項(xiang)目(mu)(mu)(mu)特點和實(shi)際需要(yao),開展實(shi)施(shi)(shi)效果監測評估(gu)(gu)。鼓勵引入專(zhuan)業機構(gou)作為第三方開展項(xiang)目(mu)(mu)(mu)實(shi)施(shi)(shi)效果評估(gu)(gu)。

  三、嚴(yan)格(ge)遵守(shou)法律法規(gui)

  (一(yi))嚴守永久基本(ben)農(nong)(nong)田保護紅(hong)線和生(sheng)態保護紅(hong)線。要嚴格遵守耕(geng)地和永久基本(ben)農(nong)(nong)田保護、生(sheng)態保護相關法律(lv)法規規定,嚴格落實(shi)《自(zi)然資(zi)源(yuan)部 農業農村部 國家林業(ye)和(he)草原局關于嚴格耕地用途管制有(you)關問題的通知》(自然(ran)資發〔2021〕166號)、《自然資源部(bu) 生(sheng)態(tai)環境部(bu) 國家林業和草原局關于(yu)加強生(sheng)態(tai)保(bao)護紅(hong)線(xian)管(guan)理的通知(試行)》(自然資發〔2022〕142號)等要求。實施生(sheng)態(tai)修(xiu)復(fu)項目(mu)過程中,不得擅自調整耕地和永久基本農(nong)田布(bu)局,不得損(sun)毀耕地,不得違反生(sheng)態(tai)保(bao)護紅(hong)線(xian)管(guan)控規(gui)則。

  (二(er))嚴(yan)明資(zi)源利用(yong)(yong)政策邊界。準確把握《自然(ran)資(zi)源部(bu)關于探索利用(yong)(yong)市場化方式(shi)推進礦(kuang)山(shan)生態修復(fu)的意見(jian)》(自然(ran)資(zi)規(gui)〔2019〕6號(hao))有關要求(qiu),屬于(yu)縣級(含)以上(shang)地方(fang)人(ren)民(min)政(zheng)(zheng)府組(zu)織(zhi)(zhi)實施(shi)(shi)、責任人(ren)滅失的歷史遺留露天開采類礦(kuang)山生(sheng)(sheng)態(tai)修復項目,方(fang)可適用有關合理利用廢棄礦(kuang)山土石料政(zheng)(zheng)策,并(bing)按照“一礦(kuang)一策”要求(qiu),在科學(xue)評(ping)估(gu)論證基礎上(shang)同步編制土石料利用方(fang)案(an)和礦(kuang)山生(sheng)(sheng)態(tai)修復方(fang)案(an),方(fang)案(an)確定的實施(shi)(shi)期限原則上(shang)不超(chao)過3年(nian),方(fang)案(an)經縣級人(ren)民(min)政(zheng)(zheng)府同意(yi)(yi),由縣級自然資(zi)(zi)源(yuan)主管部門報(bao)市級自然資(zi)(zi)源(yuan)主管部門審查同意(yi)(yi)后實施(shi)(shi);凡涉(she)及(ji)剩余廢棄土石料對外(wai)銷售(shou)(shou)(shou)的,由縣級人(ren)民(min)政(zheng)(zheng)府組(zu)織(zhi)(zhi)納入公共(gong)資(zi)(zi)源(yuan)交易平臺進行銷售(shou)(shou)(shou),不得(de)由項目承(cheng)(cheng)擔單位、施(shi)(shi)工(gong)單位或個人(ren)直接銷售(shou)(shou)(shou),銷售(shou)(shou)(shou)所得(de)收(shou)益納入本級人(ren)民(min)政(zheng)(zheng)府財政(zheng)(zheng)賬戶,全部用于(yu)本地區生(sheng)(sheng)態(tai)修復,涉(she)及(ji)社會投資(zi)(zi)主體承(cheng)(cheng)擔修復工(gong)程的應(ying)保障(zhang)其(qi)合理收(shou)益。

  (三(san))嚴(yan)格(ge)用(yong)(yong)海(hai)用(yong)(yong)島(dao)(dao)(dao)規(gui)(gui)(gui)定。嚴(yan)禁(jin)借海(hai)洋生(sheng)(sheng)態(tai)(tai)(tai)保護修復之名,變相實施、造成(cheng)事實性(xing)填(圍(wei))海(hai)或(huo)人(ren)工促(cu)淤。在海(hai)島(dao)(dao)(dao)修復項目中,嚴(yan)禁(jin)實施各類(lei)違反(fan)法律法規(gui)(gui)(gui)規(gui)(gui)(gui)定的(de)采(cai)(cai)石(shi)、挖海(hai)砂、采(cai)(cai)伐林木等(deng)破壞無(wu)居(ju)民海(hai)島(dao)(dao)(dao)的(de)行(xing)為(wei),嚴(yan)格(ge)限制填海(hai)連島(dao)(dao)(dao)、嚴(yan)重改(gai)(gai)變海(hai)島(dao)(dao)(dao)自然(ran)地(di)(di)形地(di)(di)貌等(deng)對生(sheng)(sheng)態(tai)(tai)(tai)環境有(you)較大影響的(de)用(yong)(yong)島(dao)(dao)(dao)活動。涉及灘(tan)涂高程或(huo)濕地(di)(di)微地(di)(di)貌改(gai)(gai)造的(de)(含(han)沙(sha)(sha)灘(tan)補沙(sha)(sha)、植(zhi)被種植(zhi)等(deng)),不得(de)將(jiang)潮間帶、潮下帶改(gai)(gai)造為(wei)潮上帶。實施生(sheng)(sheng)態(tai)(tai)(tai)保護修復項目,不得(de)違背自然(ran)規(gui)(gui)(gui)律,采(cai)(cai)用(yong)(yong)人(ren)工干(gan)預方式(shi)建設(she)人(ren)造沙(sha)(sha)灘(tan);不得(de)改(gai)(gai)變自然(ran)岸(an)線(xian)的(de)海(hai)岸(an)形態(tai)(tai)(tai)和生(sheng)(sheng)態(tai)(tai)(tai)功能;人(ren)工岸(an)線(xian)生(sheng)(sheng)態(tai)(tai)(tai)化建設(she)應(ying)盡量達(da)到生(sheng)(sheng)態(tai)(tai)(tai)恢復岸(an)線(xian)的(de)認定標準。  

  海(hai)(hai)洋(yang)生態(tai)保護(hu)修復(fu)項(xiang)目中的海(hai)(hai)堤(含鎮壓層)、突堤、離(li)岸堤(含潛(qian)堤)、棧橋、圍堰(含臨(lin)(lin)(lin)時(shi)(shi)(shi)圍堰)等構筑(zhu)物(wu)建(jian)設(she)(she),人(ren)工(gong)魚礁、牡蠣附著礁等礁體(ti)投放、清淤疏浚及(ji)其他涉及(ji)持續(xu)使用(yong)特定海(hai)(hai)域(yu)的排他性工(gong)程措施用(yong)海(hai)(hai),在(zai)實施前(qian)應當(dang)依(yi)(yi)法依(yi)(yi)規(gui)辦理(li)海(hai)(hai)域(yu)使用(yong)審批手(shou)續(xu)或(huo)(huo)臨(lin)(lin)(lin)時(shi)(shi)(shi)海(hai)(hai)域(yu)使用(yong)手(shou)續(xu);海(hai)(hai)洋(yang)生態(tai)保護(hu)修復(fu)項(xiang)目中不(bu)足(zu)三個(ge)月的臨(lin)(lin)(lin)時(shi)(shi)(shi)圍堰可辦理(li)臨(lin)(lin)(lin)時(shi)(shi)(shi)海(hai)(hai)域(yu)使用(yong)手(shou)續(xu);涉及(ji)在(zai)無(wu)(wu)(wu)居民海(hai)(hai)島(dao)上開(kai)(kai)展建(jian)筑(zhu)物(wu)或(huo)(huo)設(she)(she)施建(jian)設(she)(she)等開(kai)(kai)發利用(yong)活(huo)動的,應當(dang)依(yi)(yi)法依(yi)(yi)規(gui)辦理(li)無(wu)(wu)(wu)居民海(hai)(hai)島(dao)開(kai)(kai)發利用(yong)審批手(shou)續(xu)。需要種(zhong)植植被(bei)、互(hu)花米草清理(li)、進行沙(sha)灘人(ren)工(gong)補沙(sha)等無(wu)(wu)(wu)構筑(zhu)物(wu)、建(jian)筑(zhu)物(wu)或(huo)(huo)設(she)(she)施建(jian)設(she)(she)的非(fei)排他性用(yong)海(hai)(hai)活(huo)動,以及(ji)拆除養殖(zhi)池、構筑(zhu)物(wu)等不(bu)足(zu)三個(ge)月的臨(lin)(lin)(lin)時(shi)(shi)(shi)施工(gong)行為工(gong)程措施,依(yi)(yi)法依(yi)(yi)規(gui)無(wu)(wu)(wu)需辦理(li)海(hai)(hai)域(yu)使用(yong)審批手(shou)續(xu)、臨(lin)(lin)(lin)時(shi)(shi)(shi)海(hai)(hai)域(yu)使用(yong)手(shou)續(xu)或(huo)(huo)無(wu)(wu)(wu)居民海(hai)(hai)島(dao)開(kai)(kai)發利用(yong)審批手(shou)續(xu)。

  (四)嚴(yan)格(ge)資(zi)(zi)(zi)(zi)(zi)金(jin)(jin)(jin)使用(yong)管(guan)(guan)理(li)。對中(zhong)央(yang)和地(di)(di)方財(cai)政(zheng)轉移(yi)支(zhi)(zhi)付資(zi)(zi)(zi)(zi)(zi)金(jin)(jin)(jin)支(zhi)(zhi)持(chi)的(de)(de)項(xiang)(xiang)目,各地(di)(di)自然(ran)資(zi)(zi)(zi)(zi)(zi)源(yuan)部門(men)(men)要按(an)照中(zhong)央(yang)與地(di)(di)方財(cai)政(zheng)事權和支(zhi)(zhi)出責任劃(hua)分(fen),配(pei)合財(cai)政(zheng)部門(men)(men)做好(hao)(hao)項(xiang)(xiang)目資(zi)(zi)(zi)(zi)(zi)金(jin)(jin)(jin)下(xia)達、執行工作。中(zhong)央(yang)財(cai)政(zheng)資(zi)(zi)(zi)(zi)(zi)金(jin)(jin)(jin)支(zhi)(zhi)持(chi)范圍要符合資(zi)(zi)(zi)(zi)(zi)金(jin)(jin)(jin)管(guan)(guan)理(li)辦法(fa)等相(xiang)關(guan)(guan)規定(ding);各級自然(ran)資(zi)(zi)(zi)(zi)(zi)源(yuan)主管(guan)(guan)部門(men)(men)應按(an)照《自然(ran)資(zi)(zi)(zi)(zi)(zi)源(yuan)資(zi)(zi)(zi)(zi)(zi)金(jin)(jin)(jin)監測(ce)監管(guan)(guan)工作規程》等有(you)(you)關(guan)(guan)要求(qiu)(qiu),配(pei)合財(cai)政(zheng)部門(men)(men)做好(hao)(hao)中(zhong)央(yang)轉移(yi)支(zhi)(zhi)付資(zi)(zi)(zi)(zi)(zi)金(jin)(jin)(jin)支(zhi)(zhi)持(chi)項(xiang)(xiang)目資(zi)(zi)(zi)(zi)(zi)金(jin)(jin)(jin)的(de)(de)全流程監測(ce)監管(guan)(guan),跟蹤掌握項(xiang)(xiang)目資(zi)(zi)(zi)(zi)(zi)金(jin)(jin)(jin)及績效目標(biao)執行情況,督促按(an)要求(qiu)(qiu)抓好(hao)(hao)項(xiang)(xiang)目建設進度,加強對信息化監測(ce)監管(guan)(guan)成(cheng)果的(de)(de)應用(yong);省(sheng)級自然(ran)資(zi)(zi)(zi)(zi)(zi)源(yuan)主管(guan)(guan)部門(men)(men)應配(pei)合有(you)(you)關(guan)(guan)部門(men)(men)制(zhi)定(ding)省(sheng)級生(sheng)態修(xiu)復(fu)項(xiang)(xiang)目資(zi)(zi)(zi)(zi)(zi)金(jin)(jin)(jin)管(guan)(guan)理(li)辦法(fa),有(you)(you)條件的(de)(de)可結(jie)合當地(di)(di)實際探索編制(zhi)生(sheng)態修(xiu)復(fu)項(xiang)(xiang)目預算標(biao)準,提高項(xiang)(xiang)目資(zi)(zi)(zi)(zi)(zi)金(jin)(jin)(jin)使用(yong)效益。對騙取(qu)、擠占、截留、挪(nuo)用(yong)項(xiang)(xiang)目資(zi)(zi)(zi)(zi)(zi)金(jin)(jin)(jin)等行為,依(yi)法(fa)依(yi)規追(zhui)究責任。

  四、加強項目實(shi)施保障

  (一)完善管(guan)理(li)機制(zhi)。各(ge)省(區、市(shi))要根據實際(ji),制(zhi)定(ding)本(ben)地(di)區國土空間(jian)生(sheng)態修復(fu)(fu)項(xiang)(xiang)目(mu)(mu)管(guan)理(li)辦法(fa),完善項(xiang)(xiang)目(mu)(mu)管(guan)理(li)制(zhi)度,明確(que)各(ge)環節管(guan)理(li)要求。中(zhong)央財政(zheng)轉移支付資(zi)金支持的(de)生(sheng)態修復(fu)(fu)項(xiang)(xiang)目(mu)(mu)實行省負總責、市(shi)縣實施的(de)責任(ren)機制(zhi),承擔項(xiang)(xiang)目(mu)(mu)的(de)地(di)方應(ying)建立政(zheng)府領導、部(bu)門合作、社會參與的(de)工作機制(zhi),明確(que)牽頭單(dan)位(wei),做好任(ren)務(wu)分工,統籌(chou)推進項(xiang)(xiang)目(mu)(mu)實施。

  (二)強(qiang)化(hua)日常監(jian)管(guan)。各地要充分利用遙(yao)感(gan)、測繪、地質調(diao)查等(deng)(deng)技術(shu)手(shou)段,對生(sheng)態修復項目實施進(jin)度、效果等(deng)(deng)進(jin)行監(jian)督(du)管(guan)理(li)。依托國(guo)(guo)土(tu)空間(jian)(jian)基礎信息平臺(tai)和(he)國(guo)(guo)土(tu)空間(jian)(jian)規劃“一張圖”實施監督系統,融合資金監管(guan)系統,因地制宜(yi)探索(suo)完(wan)善國土空間生態(tai)修(xiu)復項目(mu)監管(guan)體系。要堅(jian)持先規劃、后實施,嚴格防范以生態(tai)修(xiu)復名義違法采礦、破壞(huai)耕地。要高度重視生態(tai)修(xiu)復項目(mu)施工(gong)安(an)全,不(bu)得(de)(de)“邊(bian)報批、邊(bian)設計、邊(bian)施工(gong)”,不(bu)得(de)(de)不(bu)顧安(an)全盲目(mu)趕(gan)工(gong)期、搶進度。

  (三)建立(li)問(wen)責機(ji)制。各地要加大監督問(wen)責力度(du),依(yi)法(fa)(fa)嚴(yan)肅查處(chu),責令限期整改,探索(suo)建立(li)失(shi)(shi)信(xin)懲戒機(ji)制,壓實項(xiang)目勘察(cha)、設計、施工(gong)(gong)、監理(li)等單(dan)位和(he)人(ren)員責任。對生態修(xiu)復(fu)中的形式主義、形象工(gong)(gong)程、虛假修(xiu)復(fu)等行(xing)為,要及時通(tong)(tong)報和(he)曝光(guang);對造成嚴(yan)重損失(shi)(shi)、出(chu)現嚴(yan)重社會(hui)負面影(ying)響(xiang)的,要依(yi)法(fa)(fa)追究(jiu)相關單(dan)位和(he)人(ren)員責任。對以生態修(xiu)復(fu)名義違(wei)法(fa)(fa)采礦、破壞耕地、違(wei)規銷售采出(chu)礦產(chan)資源或者超(chao)出(chu)批準的項(xiang)目范圍采挖礦產(chan)資源等違(wei)法(fa)(fa)行(xing)為的,要移交執法(fa)(fa)機(ji)構調查處(chu)理(li)。部將視情綜合運用執法(fa)(fa)、檢(jian)查、約談(tan)、通(tong)(tong)報等方(fang)式開展(zhan)監督。

  (四)加強社(she)會監督(du)。各(ge)地(di)要建立健全項目公示制度,利用(yong)當(dang)地(di)廣播、電視、報紙、政(zheng)府(fu)網站(zhan)等,按規定公開生態修(xiu)復(fu)項目基(ji)本信息(xi)及(ji)設計、施工、監理(li)等單位信息(xi),接受社(she)會監督(du)。加強生態保護修(xiu)復(fu)科(ke)普宣傳教育,營造良(liang)好社(she)會氛(fen)圍(wei)。
